The Case for Internet Tax Reform

Interesting article about the important unfair advantage internet companies have over brick & mortar retail stores. There is a big push in Washington to level the retail playing field; here is an update.

Retail Groups Push For Internet Sales Tax Reform In D.C.

Excerpted from ICSC Smart Brief; By Steve Smith — TWICE, 4/26/2012

Washington – The Consumer Electronics Association (CEA) — along with the International Council of Shopping Centers (ICSC) and Retail Industry Leaders Association (RILA) — has made their case to the media for Internet tax reform.

The pitch was delivered to Congress recently along with many members of CEA’s board.

Shapiro told TWICE that while CEA members include online retailers and it was “difficult to get to a position” on the issue, there have been no complaints by any members since it decided to back the tax. “It is viewed as inevitable,” Shapiro said.

The proposed bills in Congress have bipartisan backing “from key Republicans and Democrats. State governors are behind it, unions are behind it. [The proposed legislation] will rationalize the tax system.”

Fry explained that for states and local governments, “sales taxes have dropped 8 to 10 percent” since the economic downturn, yet sales and profits of online retailers have skyrocketed.

He gave the perspective from the brick-and-mortar sales floor. “Consumers come in and match prices with their smartphones. We have a policy, like others, to match online prices. Then some will say, “Will you match the online sales tax?’ and they walk.”

Another problem is ignorance of the law — consumers have to voluntarily pay sales taxes in the 45 states that there are laws about it. Fry noted, “Consumers, and we found out today members of Congress, are ignorant of the fact that they owe taxes.”

The legislation is not a tax hike, according to Fry. “It empowers states to collect taxes already due.”

Fry cited the case where Amazon has begun emailing notices to all its Tennessee customers that they may owe taxes on past purchases and stems from a law signed in the state a month ago.

Fry noted that “an amnesty for past purchases” should be part of the bill and could be a palatable way for some members of Congress to vote for such legislation.

He said that in today’s climate those who would want to start a brick-and-mortar retail business are at a “6 to 10 percent disadvantage” vs. online retailers.

“Online retailers have enjoyed a 40 percent growth rate … in a down economy,” he noted, and consumers looking for a deal of not paying sales tax is part of the reason for that growth.

That not only hurts brick-and-mortar retailers but states and local governments that will either have to cut services or “raise income taxes, something that no one wants” to make up the difference, Fry said.

Betsy Laird, senior staff VP, office of global public policy for the International Council of Shopping Centers, said the chances of passing such a bill during a presidential election year are “challenging” but that it has seen “traction on the issue” and that it may be dealt with during the lame duck session of Congress after the November elections.

She noted that 21st century retailing is “not like it was 20 years ago” when a U.S. Supreme Court decision set the mold for the current market and “not like it will be in 2032.” The proposed legislation is not one-size-fits-all, since it has provisions to “do what is right for a particular state. The concerns of Texas are different from those in California, for example.”

Brian Dodge, RILA communications and state affairs senior VP, said the House and Senate versions of the bill aim to “level the playing field” that provides online retailers with an advantage over brick-and-mortar competitors.

Dodge noted the proposals will “stop government from picking and choosing winners” in the marketplace.

Shapiro noted, “Can you imagine, after the presidential election, no matter who wins, there will be new appointees before Congress. They will probably be asked, as were appointees 20 years ago, about the ˜nanny tax’ if they paid Internet sales taxes. If they didn’t, they will have failed to comply with the law.”

He added that for the CE industry, the survival of independent retailers that introduce technology and provide the “touch and feel” of cutting-edge products is vital for the industry. “While we supported the 1992 Supreme Court decision, we have changed our position” as e-commerce sales are now estimated at more than $175 billion in the U.S. annually.

RiverCenter and the Borough met several times with NJNG over the past year to try to convince them not to move the regulators aboveground, but to no avail. Last month, NJNG filed a lawsuit against RiverCenter and the Borough of Red Bank claiming they were being prohibited from moving the existing underground regulators to above ground in front of the stores and restaurants. They now claim safety concerns and have filed with the courts to have them force us to allow the installation. We have retained counsel and have submitted our response to their complaint along with our affidavits as to our side of this issue. We contend that with regular maintenance the regulators that have been successfully functioning in underground pits, can remain there. We have a hearing in court on May 16th.

It’s Pink Time again!

It takes a village to help Riverview Medical Center achieve the mission of Paint the Town Pink. And, every year, that village grows with more towns and more supporters helping them to encourage women, ages 40 and older, to have their annual mammogram. In Conjunction with The Women’s Center, Paint the Town Pink strives to educate local women about a very significant fact that ”early detection is a woman’s best defense against breast cancer.”

Our annual event merges a breast cancer prevention, detection and treatment campaign with a fundraising component that raises funds to provide free screenings through the Pink Fund, at the Women’s Center at Riverview, for uninsured and underserved women in the community. It is collaboration between Riverview Medical Center and surrounding towns. Riverview’s Pink towns add their own unique town personality, adding to the special nature of “Pink.”

My Wonderful Day, May 15, 2012 – June 3, 2012By Alan Ayckbourn
Directed by Nicholas MartinJOAN AND ROBERT RECHNITZ THEATER

Winnie Barnstairs, a nearly 9-year-old, Anglo-Caribbean girl from south London, has a school assignment to write an essay about her day. By chance, she is spending it with her mother, a house cleaner who works for a rich, unhappily married, minor television celebrity. Instructed to get on with her homework, Winnie sits quietly with her notebook and does just that, observing and recording all the events around her…even as the day turns into an increasingly frenetic domestic farce of marital infidelity, volcanic egos, and comic misunderstandings. Written by one of the world’s most popular playwrights, My Wonderful Day is an insightful, compassionate, and utterly hilarious comedy about life’s disappointments, as seen through the eyes of a watchful child.

Help make the second Barnegat Bay Blitz better than the first!

On Wednesday, October 19, 2011, over 2,400 volunteers (including DEP Commissioner Martin, DEP officials and staff), cleaned up dozens of areas in the Barnegat Bay watershed’s 37 municipalities. Volunteers came from a wide array of local groups including students, senior citizens, environmentalists, business and local government leaders, and even military personnel from Fort Dix.

The 2011 blitz was a major success. Volunteers gathered 739 bags of trash plus 578 bags of recyclables. In addition, 3 30-yard dumpsters and 3 dump trucks were filled!

Since 1974 Earth Treasures, Monmouth County’s favorite jeweler, has grown in popularity so much that it has outgrown its present space. Owner, Paul Bischoff, decided it was time to move a few doors down to a bigger and better new store. The move is all about maintaining the foundation of service and improving the selection and convenience of shopping that Earth Treasures has always been known for.

To kick-off the grand re-opening event scheduled for the week of April 24th, the festivities will begin with a Ribbon Cutting Ceremony Tuesday, April 24th, at 9 a.m. In attendance will be Eatontown Council members, Paul Bischoff and his staff, and various workers who made it all happen.

“Our goal,” says Bischoff, “was to create a client-friendly showroom that featured an expanded selection, is comfortable to browse, and has all the services you would ever want from a fine jeweler.” It was important to everyone at Earth Treasures to remain situated in their convenient plaza, soon to be renamed “Michael’s Plaza,” at the intersection of Routes 35 & 36 in Eatontown.

To celebrate its Grand Re-opening and to honor and reward its past, present, and future customers, the new Earth Treasures will be inviting all to experience the new store and enjoy up to 60% off every new item from Tuesday, April 24th to Saturday, April 28th.

And from Tuesday, May 1st to Saturday, May 12th, Earth Treasures welcomes you to its popular annual Estate Event, when every item in the expanded estate jewelry collection will be discounted up to 60% off the already low prices. These “Celebration Savings” are the real deal as the regular discounted pricing at Earth Treasures consistently beats competitors’ sale prices.

Support the Importance of Mammography by Decorating Your House Pink May 4 – May 12

“Pink Bank, NJ” – April 9, 2012 – Residents of “Pink Bank” (Red Bank), “Pink Beach” (Monmouth Beach), “Pink Haven” (Fair Haven), “Atlantic Pinklands” (Atlantic Highlands), “Pinkdel” (Holmdel), “Little Pink” (Little Silver), “Pinkson” (Rumson), and “Pinkbury” (Shrewsbury), are invited to turn your towns pink for nine days this spring by “Pinking Your Houses” from May 4 through May 12, the duration of this year’s Paint the Town Pink.

Sign up for the “Pink Your House” contest to show your support of the sixth annual Paint the Town Pink initiative hosted by Riverview Medical Center. Each participating home will receive a Paint the Town Pink Starter Kit to get the pink creativity flowing. Residents can either decorate their houses using the starter kit, or can enter the house decorating contest and put their creativity to the test. In past years, residents have wowed us with some unique PINK decorations and survivor tributes.

The starter kit, which will be dropped off to your home, will include: a Paint the Town Pink lawn sign, Paint the Town Pink flag, Paint the Town Pink window cling, a pink bow, and a washable pink window marker. The contest entrants will be judged by our panel of Pink judges the weekend of May 4th. There will be three winners per town, one in each category of Most Creative, In Honor of a Survivor, and Pinkest House.

Paint the Town Pink was created with the goal to encourage women aged 40 and older to pledge to have their annual mammogram, as well as raise funds to provide mammography to the uninsured and underserved in our community. Through a variety of special events and in-store specials from hundreds of businesses, the “Pink Your House” contest, and involvement from community groups, this year’s Paint the Town Pink will be “bigger and Pinker” than ever before!

To sign up to Pink Your House visit www.PainttheTownPink.com and click on “Pink Your House.” The entry deadline is April 13, 2012.

Paint the Town Pink 2012 runs from May 4-12. Be sure to follow Paint the Town Pink on Facebook to see highlights of this year’s campaign and for a complete list of events and activities.

SHREWSBURY, N.J. – MARCH 24, 2012 – Koko FitClub, the world’s first automated personal training studio, has arrived in Shrewsbury. To celebrate the occasion, a public Grand Opening event and ribbon cutting ceremony took place on Saturday, March 24 from 11 a.m. to 3 p.m., featuring refreshments, giveaways, special guests and grand prizes. The first 50 guests to arrive at the Grand Opening received a free Koko FitClub gym bag and water bottle.

TO PROVIDE PATIENTS WITH THE FINEST HEALING ENVIRONMENT

Red Bank, NJ – March 27, 2012 – Last spring, Riverview Medical Center announced the creation of a nearly 22,000 square foot center for surgical excellence to be constructed in the Blaisdell Pavilion, on the Medical Center campus, supported by the Riverview Medical Center Capital Campaign, Life. Changing. Riverview is pleased to announce that the first phase of this expansion, the new Surgical Day Stay, is completed and operational starting today.

“Surgical Day Stay at Riverview has a long history of delivering exceptional pre and post surgical care and service to the communities it serves,” says Timothy J. Hogan, FACHE, regional president for Riverview Medical Center and Bayshore Community Hospital. “Environment of care plays a significant role in the total hospital experience and the new area affords Riverview an increased opportunity to provide our patients and families with a personalized health care experience in a more comfortable and healing environment. In addition, the relocated and renovated Surgical Day Stay will keep Riverview on the leading-edge in the delivery of care and surgical innovation and education.”

Some of the changes to new Surgical Day Stay include:

Patients and loved ones will be greeted by a team member when they enter the oversized surgical waiting area. This space hosts lounge style comfortable chairs, a flat screen television, calming fish tank, and nourishment area to provide a more relaxed “at home” feel.

Once in the unit, patients will be placed in one of 23 new healing bays
(21 semi-private and two private bays). Each bay is equipped with a 26” television, along with individually keyed lockers for personal items, and comfortable chairs for family or friends. To create a more healing environment, each bay will also have three options for overhead lighting that can be controlled by the patient.

After a procedure, should the surgeon wish to discuss private matters with the family, a new private consultation room is available within the space.

“Over the past three years, Riverview’s surgical volume has grown by more than 20% and has created a need to improve and enhance our current operations,” says John Rose, M.D., chairman of surgery at Riverview Medical Center. “The establishment of this high-tech facility is the next step in advancing the Medical Center’s mission to provide exceptional care to the community in an environment that is comfortable and close to home. Riverview continues to make significant advances in surgery and we are looking forward to the completion of the next phases of our expansion project for improving surgical services.”
